This Site and its components are provided for informational purposes; this Site and Flonium shall not be responsible or liable for the accuracy, usefulness, or availability of any information transmitted or made available via the Site, and shall not be responsible or liable for any error or omission in those information.

POE Service:

Pre-Order Evaluations and Forms thereof in this Site are provided as a Service to users. Users can make a request for a Pre-Order Evaluation (referred to as ‘POE’ from here on) about Flonium’s particular products and services (presented on the Site) by submitting a POE Form (which is specific for each product or service) via the Site. Once a user makes a POE request, all information (in any form; written, verbal, visual, etc.) and correspondences (in any form; written, verbal, electronic, etc.) provided by Flonium and/or this Site to the user about that particular product or service (about which the POE is requested) altogether constitute the POE being requested. POE gets finalized and is finished by providing the user with a final document or correspondence, being noted as such on the document/correspondence, summarizing the evaluations (in part or as a whole) being provided to the user. POE is based for the most part on the information provided by the user (either via the POE Form or via other correspondences). POE gets provided to the best of Flonium’s knowledge, and Flonium shall not be responsible or liable for the accuracy, usefulness, or availability of any POE information being provided, and shall not be responsible or liable for any error or omission in those information. Users can make a Pre-Payment via the Site, to secure their POE requests. If a user chooses to make a Pre-Payment for securing the POE request being made, then the user can Cancel his/her POE request with full refund of the pre-payment within the first 7 calendar-days of the Pre-Payment, by submitting his/her Cancellation request within that time. If the user Cancels his/her POE request within the 5 calendar-days of the Pre-Payment he/she made, then Flonium will issue a full refund of the pre-payment to the user within 20 business-days of the date the Cancellation request was received by Flonium. Beyond the 5 calendar-days of the Pre-Payment, POE that is requested becomes non-refundable and Flonium shall not issue any refund (of any kind) of the Pre-Payment to the user. If a POE request is made without any Pre-Payment, then Flonium is not obligated in any way to provide a POE to the user. If a user however makes the determined Pre-Payment via the Site and does not Cancel his/her POE request made, then Flonium shall provide and finalize the POE requested within 30 business-days (excluding time being lost due to force-majeure events) from the date of the pre-payment to the user. If the user chooses to place a Purchase Order (for that or a similar product for which the POE request was made) within 10 calendar-days of receiving his/her POE from Flonium, then Flonium would apply the pre-payment (the user made for POE) fully towards that Purchase Order. The user can also Cancel that Purchase Order (the user had placed). If the user Cancels the Purchase Order within 15 calendar-days of placing the Order, then Flonium will issue a full refund of the payment (that the user had made for placing the order) minus the POE pre-payment amount (if the user had made one) within 20 business-days of the Cancellation request. If the user however Cancels the Purchase Order within 30 calendar-days of placing the Order (i.e. after the 15th day but before the 31st day), then Flonium will refund at most 90% of the payment (that the user had made for placing the order) minus the POE pre-payment amount (if the user had made one) within 20 business-days of the Cancellation request. Beyond the 30 calendar-days of placing the Purchase Order, the Purchase Order (that was placed) becomes non-refundable, and Flonium shall not issue any refund (of any kind) of any payment to the user.

Governing Law and Jurisdiction:

This Agreement and all other aspects of your use of this Site shall be governed by the laws of the State of Delaware (in the United States of America).

Changes to This Agreement:

These Terms of Use are subject to change at any time without notice. Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use and stop accessing this site immediately.
